These Terms and Conditions apply to the use of The Netherlands Beneath Your Feet, including the website, interactive map, texts, images, route descriptions and digital products such as paid PDF routes. By using the website or purchasing a digital product, you agree to the terms that apply to that use or purchase.
1. About The Netherlands Beneath Your Feet
The Netherlands Beneath Your Feet is a website about remarkable places, stories and routes in the Netherlands. The website is available at www.nederlandonderjevoeten.nl. For questions, complaints or support, you can email info@nederlandonderjevoeten.nl.
When a digital product is offered through an external sales or payment platform, the seller, price, payment and delivery information relevant to the purchase is also shown on the relevant sales page or during checkout.
2. Applicability and order of precedence
These terms apply to visitors, users and consumers who purchase a digital product. Different arrangements apply only if they have been confirmed in writing.
Additional terms may apply to a specific route, download, offer or external sales platform. In the event of a conflict, a specifically agreed provision takes precedence over these Terms and Conditions to the extent permitted by law. Mandatory consumer rights always remain in force.
3. Use of the website
You may use the website and the free information for personal, non-commercial purposes. Without permission, you may not:
- automatically and on a large scale extract or copy the website, data files or content;
- circumvent security measures or disrupt the operation of the website;
- publish, sell or commercially reuse content as your own work;
- use the website for unlawful, misleading or harmful activities.
Normal indexing by regular search engines and sharing an ordinary link to a public page are not covered by this prohibition.
4. Information, sources and accuracy
The information on The Netherlands Beneath Your Feet is prepared with care. However, texts, routes, opening hours, access, prices, accessibility, parking rules, paths, traffic conditions and local circumstances may change. Before setting off, always check current information yourself with the site manager, location, municipality or another relevant source.
Historical information, folklore, legends and local traditions may be based on sources that complement or contradict one another. Where possible, a distinction is made between demonstrable facts, probable interpretations and tradition. Complete historical certainty cannot always be guaranteed.
5. Following routes and visiting locations
Following walking routes, driving routes or other route descriptions and visiting locations is at your own responsibility. You remain responsible for, among other things:
- your safety, health, fitness, equipment and choice of weather conditions;
- complying with traffic rules, parking rules, opening hours and instructions on site;
- assessing whether a path, terrain or location is accessible and suitable;
- respecting private property, residents, nature, cemeteries, religious sites and vulnerable heritage.
A route description is not a substitute for current signposting, traffic information, emergency alerts or instructions from competent authorities. Always follow the situation on the ground.
6. Digital products
The Netherlands Beneath Your Feet may offer digital products, including PDF routes, route guides and other downloadable files. The sales page states the main characteristics of the product, the price, any taxes, the method of payment and how access or delivery will take place.
Images and examples on a sales page are for illustration. Small differences in layout, colour display or file rendering may arise because of the device, screen, browser, PDF reader or printer settings.
7. Orders and formation of the agreement
An order is formed after you have completed the ordering process, the amount due has been accepted for payment and the order has been confirmed by or through the sales platform. Obvious errors in prices, product descriptions or technical display do not bind The Netherlands Beneath Your Feet where you could reasonably have understood that an error had occurred.
You are responsible for providing a correct email address and any other information required for payment and delivery.
8. Prices and payment
The applicable price is stated on the sales page and shown before you complete the order. It will also be stated whether taxes or other mandatory charges are included in the price. No additional charges will be made unless they were clearly shown before the order was placed.
Payment may be processed through an external sales, payment and download service such as Payhip and through the payment methods offered there. The Netherlands Beneath Your Feet does not itself process or store full payment card details. The terms of the relevant payment provider may also apply to payment processing.
9. Delivery of digital downloads
After successful payment, the digital product is made available through a download link, account, email or another method described on the sales page. Also check your spam or junk email folder if an expected delivery email is not immediately visible.
To open and use a digital product, you need a suitable device and, depending on the file format, appropriate software. A standard PDF reader is required for PDF files. Unless stated otherwise, internet, device, software and printing costs are not included in the purchase.
10. Right of withdrawal for digital content
For an online consumer purchase, a statutory cooling-off period generally applies. For digital content that is not supplied on a tangible medium, the right of withdrawal may end once delivery begins, but only if you have expressly agreed in advance to immediate delivery and acknowledged that you thereby lose your right of withdrawal.
If those conditions have not been validly met, the statutory rules on withdrawal continue to apply. The full explanation and a model statement are available on the Right of Withdrawal for Digital Downloads page. That page forms part of these terms.
11. Problems with a download
A digital product must conform to what was reasonably agreed and described on the sales page. If the download link does not work, the file is corrupted, an essential part is missing or you cannot open the file because of a delivery error, email info@nederlandonderjevoeten.nl and state the product name, purchase date, email address used and a clear description of the problem.
Where there is a lack of conformity for which The Netherlands Beneath Your Feet is responsible, an appropriate statutory remedy will be sought within a reasonable time, for example repair, replacement access, a new file, a price reduction or, where the statutory conditions are met, termination and a refund.
12. Updates and changes to digital products
Errors in a digital product may be corrected. A download may be replaced by a corrected or technically improved version. Minor changes that do not adversely affect the agreed use do not automatically entitle you to a refund.
Where a necessary change materially affects use, the applicable statutory consumer rights will be respected. Unless expressly stated otherwise, a one-off purchase does not include unlimited future content updates or new editions.
13. Personal licence
When you purchase a digital download, you receive a limited, personal, non-exclusive and non-transferable licence to use it. You may keep the file for yourself, use it on your own devices and print it for personal use. This licence does not give you ownership rights in the digital product.
Without prior written permission, you may not:
- resell, rent, sublicense or include the product in another paid product;
- upload it publicly, publish it or distribute it through websites, social media, cloud folders or groups;
- systematically copy it for others or use it within an organisation, course or commercial activity;
- edit it or remove source credits with the aim of presenting the product as your own work.
14. Intellectual property
The original texts, selections, route concepts, design, structure, data files, maps and digital products of The Netherlands Beneath Your Feet are protected by copyright and other applicable rights. Purchasing a download does not transfer those rights.
Images, map data and other third-party materials remain subject to the rights and licences of their respective creators or rights holders. Where required, the source, creator, licence and any changes are stated.
15. Availability and external services
The Netherlands Beneath Your Feet aims to keep the website and downloads available with care, but cannot guarantee that the website will always be accessible without interruption or technical errors. Maintenance, security measures, outages and changes at hosting, mapping, sales or payment providers may temporarily affect availability.
The website may contain links to external sources, mapping services, heritage databases, sales pages and other websites. The Netherlands Beneath Your Feet does not control those external services and is not responsible for their content, availability, terms or privacy practices.
16. Liability
The Netherlands Beneath Your Feet is not liable for damage arising solely from ignoring current information, traffic rules, warnings, closures or instructions on site, or from using the website or a route in a way for which it was not intended.
To the extent permitted by law, liability for indirect loss, consequential loss and loss caused by temporary unavailability or third-party information is excluded. This limitation does not apply in cases of intent or deliberate recklessness and does not limit any liability or consumer right that cannot be excluded or limited under mandatory law.
17. Privacy
Information about the processing of personal data, technical data, local browser storage and data relating to digital purchases is provided in the Privacy Policy of The Netherlands Beneath Your Feet.
18. Complaints and contact
If you have a question, complaint, error report or problem with an order or download, email info@nederlandonderjevoeten.nl. Describe the issue as clearly as possible and, where relevant, include the product name, purchase date and the email address used.
The Netherlands Beneath Your Feet aims to respond to complaints carefully and within a reasonable time. This complaints procedure does not limit your right to approach a legally competent dispute resolution body or court.
19. Changes to these terms
These Terms and Conditions may be amended when the website, offer, payment method, services used or applicable legislation changes. The latest version is always available on this page. For a completed purchase, the terms that applied when the agreement was concluded remain applicable unless a change is legally required or expressly agreed with you.
20. Governing law
Dutch law applies to these terms and agreements with The Netherlands Beneath Your Feet. If you live in another country as a consumer, the mandatory consumer rights of your country of residence remain applicable to the extent that they cannot be set aside under applicable international law.
Disputes will be submitted to the court with jurisdiction under the law. This provision does not deprive consumers of any protection or procedural rights they have under mandatory law.
